What Byron asks for

Byron regulates on-site systems more formally than most NSW councils. Its on-site sewage management pages sit on top of an adopted On-site Sewage Management Strategy and companion OSMS Guidelines covering design, construction, installation, replacement, repair, alteration and maintenance — written with the shire's sensitive receiving environments in mind: drinking water sources, groundwater and the oyster aquaculture areas of the Brunswick estuary.

The practical local twist is council's register of suitably qualified persons. Site and soil assessments, system design and AWTS servicing are expected to be done by people on that register, who must hold relevant training and insurance ($10 million public liability, plus $1 million professional indemnity for designers). Choose your consultant off the register before you spend money on a report.

  • s68 application to install or alter, with a site and soil assessment to AS/NZS 1547 by a suitably qualified person
  • Approval to operate for every system; new owners must apply within three months of purchase
  • 2025–26 fees list the operate application at $65 and a pre-purchase inspection and report at $761

Owners are expected to watch for leaks, soggy ground and odours and act early — the same signals in our signs of failure guide. AWTS carry the standard quarterly servicing condition, performed by a registered agent.

Common questions

Who can do my site and soil assessment in Byron Shire?

Someone on council's register of suitably qualified persons — assessors, designers and AWTS service agents on the register hold the training and insurance council requires. Engaging off-register can mean a rejected report and paying twice.

What does Byron's OSMS strategy mean for my block?

The strategy and guidelines set design and siting expectations for the shire's sensitive catchments — drinking water sources, groundwater and oyster areas. Constrained sites can expect higher-treatment systems and conservative land application areas; compare system types before you get quotes.

I'm buying in Byron — what will the septic checks cost?

Council's 2025–26 fees list a pre-purchase OSMS inspection and report at $761, and new owners must apply for an approval to operate ($65 application) within three months of purchase. Our buyer's guide covers the rest of the checklist.
